There are three different types of Street Trading Permits:

● Pie Carts/Mobile Diners
● Newspaper Vendors

Anyone is eligible to apply for a Street Trading permit.

● A Certificate of Currency of your Public Indemnity Insurance (minimum $20million)
Pie Carts/Mobile Vendors
● Certificate of Currency for Public Liability Insurance (minimum $20million)
● WorkCover Registration Certificate
Newspaper Vendors
● Certificate of Currency for Public Liability Insurance (minimum $20million)
Applications for Temporary Street Trading Permits need to be received by Council at least 5 (working) days before the activity is to take place.

Temporary Street Trading Stand Conditions
1. The Permit Holder agrees:
1.1 To leave the Area and its surrounds in a clean and tidy condition at the end of the period of trading.
1.2 At the end of the period of trading the Council will inspect the Area to ensure that it has been cleaned and tidied to an acceptable standard.
1.3 Where the Council has to undertake cleaning and/or tidying of the Area, the Permit Holder will be liable to reimburse the Council for all costs incurred by the Council in relation to the cleaning and/or tidying of the Area.
1.4 To be responsible for and to ensure the orderly conduct of members of the public within the Area;
1.5 Not to cause any disturbances or nuisances to users of land adjacent to the Area or to vehicles or pedestrians traveling along the Area;
1.6 To ensure any structures, fixtures, fittings or furniture placed in the Area do not have the effect of restricting reasonable access to the Area for vehicles and pedestrians;
1.7 That the Activity authorised by this Permit shall be undertaken in accordance with the plans and details accompanying the application and any Adelaide City Council’s Mobile Vending Operating Guidelines and other relevant Policies in relation to the Permit.
1.8 That the permit may be cancelled or suspended by the Adelaide City Council at any time by written notice to the Permit Holder.
1.9 That the cancellation or suspension of the Permit by the Adelaide City Council pursuant to Special Condition 1.8 shall not give rise to any claim for damages on any basis by the Permit Holder.
1.10 Any breaches of Section 222 of the Local Government Act and By-Law No. 2 be reported and expiation notices issued.
1.11 Licences as approved shall not be transferred, assigned or sub-let.
1.12 All employees working in or operating a Mobile Vending Stand shall be presented in neat and professional manner.
1.13 Sufficient waste and butt out bins to be provided for patrons.
1.14 Any approved use of the carriageway, footpath or laneway related to the sale of goods must be designed in a way that does not impede pedestrians and ensures that access and egress can be made readily available in the event of an emergency.
Additional Food Vendor Conditions
1. All operators to notify the Council's Environmental Health Services team using the attached Food Act Notification Form
2. Temporary stalls who wish to be exempted from requirement to have permanent hand washing facilities with warm running water must apply to Council's Environmental Health Services team prior to trading using the attached application form
3. All liquid waste (including waste water and waste oil) must be contained and removed or disposed to sewer if available at the end of trading
4. No waste or other material is to be deposited into the storm water system. No hosing down of areas is to take place.
5. Cooking and heating appliances shall be out of the reach of the public.
6. Gas bottles, gas lines and fire fighting equipment must comply with safety requirements recommended by the South Australian Metropolitan Fire Service.
7. Fire fighting equipment to be provided by operators where cooking and heating appliances are used.
8. All stands to have suitable containers for the storage of refuse which shall be removed by the operator at the completion of trading each night.
9. Food stands shall have adequate, independent lighting and all lighting and power installations shall comply with Australian Standard 3002-1985 “Electrical Installations - Shows and Carnivals”.
10. Operators of food stalls must comply with the Food Act, 2001, relevant food and hygiene regulations, Food Safety Standards and other relevant legislation details of which are available from the Council’s Health Section.

Additional Liquor Licence Conditions
1. To comply with the requirements of the Liquor Licensing Act and any Licence issued pursuant to that Act;
2. Licences for the establishment or operation of temporary liquor bars on any carriageway, footpath or laneway should be conditioned through the liquor licensing process to incorporate the relevant provisions of the appropriate precinct policy statement where one exists.
3. Where a precinct policy statement does not exist the following core principles, plus any other agreed conditions negotiated through the liquor licensing process, apply to the licence:-
3.1 no bar is to encroach onto the roadway beyond the “stall line”, which is generally marked by any existing protuberance or by the parking bay but in any case must be no more than 3.6metres from the line of the kerb proper.
3.2 any approved use of the carriageway, footpath or laneway related to the consumption of alcohol must be designed in a way that does not impede pedestrians and ensures that access and egress can be made readily available in the event of an emergency.
4. All drink containers will be either metal or plastic of approved standard – no glass.
Pie Cart Conditions
1. The Permit Holder agrees:

Newspaper Vendors
1. The permitted activity is confined to the immediate vicinity of the permitted location.
2. This permit allows two persons only to carry out the permitted activity unless otherwise stated.
3. No obstruction is to be caused to pedestrian traffic.
4. No harassment of the public is to occur.
5. The permit holder is to comply with any instructions which may be issued by an authorised Council or Police Officer.
6. The area must be left in a clean, tidy condition and litter free.
7. This permit gives permission for the permit holder and is not transferable to any other person.
8. This permit is to be carried at all times while performing permitted activities, and produced upon request by an authorised Council or Police Officer.
9. Upon the expiry of this permit, the activity shall cease. If it is desired to continue the activity a new application needs to be lodged with Council and a permit obtained.
10. The Council reserves the right to revoke the permit at any time.
11. The erection of tables, setup of infrastructure and the use of amplified sound are not permitted.
Pie Carts / Mobile Diners
Pie Carts/Mobile Diners are also issued with a licence to operate.
Costs
Temporary Street Trading Stands
● Commercial: $58 per stand per day
● Charities: $29 50% of commercial fee
Newspaper Vendors
● $735 per stand per annum
Pie Carts/Mobile Diners
● Fee determined on individual location
